1. Preamble
bg-remove.ai (hereinafter referred to as the “Operator”) operates and manages the website bg-remove.ai (the “Platform”), which is an online photo editing application. Before using any services provided by bg-remove.ai, please read these Terms and Conditions (the “Agreement” or “Terms of Use”). This Agreement is legally binding on both the Operator and all users of the Platform bg-remove.ai (hereinafter referred to as the “Users”). By using this website in any way—including but not limited to using its services, browsing its features and content, or exploring its application—Users agree to be bound by these Terms of Use. This Agreement applies to all Users of the website and its services.
2. User Rights
2.1 Users are permitted to access and use the Platform for both commercial and non-commercial purposes. However, all results obtained from using the Platform may only be used privately. Usage for direct or indirect commercial purposes is expressly prohibited.
2.2 The Operator reserves the exclusive right to restrict access to the Platform or block specific Users without providing any justification.
2.3 By accessing the Platform, Users agree that the Operator has the right to store Users’ IP addresses to monitor the Platform’s overall usage.
3. Users’ Rights and Obligations
3.1 Users must refrain from any behavior that may damage or impair the functionality or operations of the Platform. Users are prohibited from scanning or testing the Platform for vulnerabilities. Additionally, Users are forbidden from bypassing security systems, accessing the Platform’s systems, or introducing malicious software.
3.2 Users are responsible for ensuring that they have the necessary rights to any photos they upload to the Platform.
4. Warranty and Liability
4.1 The results and availability of the Platform are not guaranteed. If any warranty claims arise, the warranty period shall be limited to six months.
4.2 The Operator assumes no responsibility for the speed, availability, data loss, or accuracy of results when using the Platform. Furthermore, the Operator is not liable for damages unless it can be demonstrated that such damages were caused by gross negligence. However, this does not apply to damages involving personal injury or loss of life.
5. Confidentiality and Data Protection
5.1 All information relating to confidentiality and data protection is made available to Users.
6. Final Provisions
6.1 Any legal disputes arising out of or in connection with this Agreement shall be governed exclusively by the laws of the United Kingdom. This Agreement shall not be subject to the United Nations Convention on Contracts for the International Sale of Goods (CISG). It is also not governed by the same principles as the International Private Law Act (IPRG) or Regulation (EC) No. 593/2008 of the European Parliament and the Council of June 17, 2008 (Rome I Regulation).
6.2 The exclusive jurisdiction for any disputes arising out of or in connection with this Agreement shall be the competent courts of London, United Kingdom.
6.3 Any amendments to this Agreement (including additions to its provisions) must be made in writing to be considered valid. This includes the requirement to revoke the formal demand for written form, which must also be done in writing.
6.4 If any provision of this Agreement is found to be invalid, unenforceable, or void, the remainder of the Agreement shall remain unaffected. The conflicting parties shall agree to replace the invalid or unenforceable provision with a neutral clause that economically achieves the intended purpose of the invalid or unenforceable provision.
6.5 If the Operator provides these Terms of Use in any language other than English, the translation shall be arranged by an ISO 17100:2015-certified independent professional translator and further reviewed by at least one expert translator. In the event of any disputes, the English version of this Agreement shall prevail, and English shall be the sole authoritative language of the text. Retranslation of the translated version is strictly prohibited and may not be used for any disputes.
